3. Not a Substitute for Professional Care

Website information is not a substitute for:

  • An examination by a qualified healthcare professional;
  • A psychiatric or medical evaluation;
  • A diagnosis;
  • An individualized treatment recommendation;
  • Medication monitoring;
  • Psychotherapy;
  • Emergency care;
  • Laboratory testing;
  • A second opinion; or
  • Ongoing treatment from a licensed professional.

Medical and psychiatric conditions can present differently from person to person. Information appropriate for one individual may be inappropriate or unsafe for another.

Do not delay, disregard, begin, discontinue, or modify professional medical care because of information found on the Websites.

4. No Physician-Patient Relationship

Viewing or using the Websites does not establish a physician-patient relationship between you and:

  • KC Psychiatry & Primary Care;
  • Dr. Asif Uddin;
  • Any Practice employee;
  • Any contractor;
  • Any contributor; or
  • Any professional mentioned on the Websites.

A physician-patient relationship is established only after the Practice has:

  1. Agreed to provide you with clinical care;
  2. Completed any required registration and intake process;
  3. Obtained required consents and acknowledgments;
  4. Conducted an appropriate professional evaluation; and
  5. Formally accepted you as a patient.

Submitting a contact form, leaving a voicemail, sending an email, requesting an appointment, creating a scheduling account, or making a payment does not by itself establish a physician-patient relationship.

5. Emergencies and Crisis Situations

The Websites, contact forms, email addresses, social-media accounts, voicemail systems, and scheduling tools must not be used for emergencies or immediate crisis intervention.

Messages may not be reviewed immediately or outside regular business hours.

When you believe that you or another person may be in immediate danger, may harm themselves or someone else, has experienced a severe medication reaction, or requires urgent medical or psychiatric attention, contact local emergency services or go to the nearest emergency department immediately.

Do not wait for a response from the Practice before obtaining emergency assistance.

6. No Diagnosis Through the Websites

Descriptions of symptoms, conditions, screening criteria, medications, or treatments are provided for general education.

Reading Website content or recognizing symptoms described on a page does not mean that you have or do not have a particular condition.

Many medical and psychiatric conditions share similar symptoms. A diagnosis generally requires an individualized evaluation that may include:

  • Medical and psychiatric history;
  • Current symptoms;
  • Medication history;
  • Physical health information;
  • Mental-status examination;
  • Laboratory testing;
  • Medical records;
  • Collateral information;
  • Diagnostic criteria; and
  • Professional clinical judgment.

Only a qualified healthcare professional who has appropriately evaluated you can provide a diagnosis or individualized recommendation.

7. Medication Information

Information about prescription medications, controlled substances, supplements, side effects, interactions, or treatment options is provided for general education only.

Website content does not constitute a prescription or recommendation that you:

  • Start a medication;
  • Stop a medication;
  • Change a dose;
  • Combine medications;
  • Replace one medication with another;
  • Use someone else’s medication; or
  • Continue a medication previously prescribed by another provider.

Abruptly stopping or changing certain psychiatric or medical medications may be dangerous.

Medication decisions must be made with a qualified prescribing professional who has evaluated your individual condition, medical history, other medications, treatment response, and risks.

The Practice does not guarantee that any particular medication, including a controlled substance, will be prescribed or continued. Prescribing decisions are made individually following an appropriate evaluation and are subject to clinical judgment, monitoring requirements, professional standards, and applicable law.

8. Treatment Results Are Not Guaranteed

Healthcare outcomes vary from person to person.

The Practice does not guarantee:

  • A particular diagnosis;
  • Symptom improvement;
  • Recovery;
  • Weight loss;
  • Medication effectiveness;
  • Absence of side effects;
  • Eligibility for a requested treatment;
  • A specific disability determination;
  • A favorable workers’ compensation outcome;
  • A fit-for-duty determination;
  • Aviation or licensing clearance;
  • A legal result; or
  • Any other particular outcome.

Statements describing possible benefits, typical experiences, or treatment approaches should not be interpreted as promises or guarantees.

9. Telemedicine Information

Website information concerning telemedicine is general and does not guarantee that telemedicine is clinically appropriate or legally available for every person.

Telemedicine eligibility may depend on:

  • Your physical location at the time of the appointment;
  • The provider’s professional licensure;
  • The nature and severity of your symptoms;
  • Technology availability;
  • Privacy and safety considerations;
  • The need for a physical examination;
  • Prescribing requirements;
  • Emergency planning; and
  • Applicable federal and state law.

A provider may determine that in-person care, emergency evaluation, laboratory testing, referral, or another form of care is more appropriate.

The Practice currently describes telehealth availability for eligible patients physically located in Kansas or Missouri at the time of the visit.

10. Adults Only

The Practice currently provides clinical services to adults aged 18 and older.

Website content concerning a condition should not be interpreted as confirmation that the Practice provides pediatric or adolescent treatment for that condition.

Parents or guardians seeking care for a minor should contact an appropriately qualified pediatric or adolescent healthcare professional.

11. Specialized, Independent, and Forensic Evaluations

Some services offered by the Practice may be evaluative, administrative, occupational, forensic, or legal rather than therapeutic.

These services may include:

  • Independent medical evaluations;
  • Workers’ compensation evaluations;
  • Disability-related evaluations;
  • Fit-for-duty evaluations;
  • Aviation-related psychiatric evaluations;
  • Expert-witness consultation or testimony;
  • Record reviews; and
  • Evaluations requested by an attorney, employer, insurer, agency, or other third party.

An independent or forensic evaluation may not create a traditional treating physician-patient relationship.

The evaluator’s role, confidentiality obligations, intended recipient of the report, permitted disclosures, and limits of privacy may differ from those applicable to ordinary treatment.

These matters should be explained in the applicable engagement agreement, consent document, authorization, referral, or evaluation notice.

Information on the Websites does not guarantee that the Practice will accept a particular evaluation or that an individual will satisfy the standards of an employer, insurer, court, licensing body, government agency, or aviation authority.

12. Website Articles and General Information

Medical and psychiatric knowledge changes over time.

Although we seek to provide useful information, Website content may not reflect:

  • The most recent research;
  • Newly issued clinical guidance;
  • Changes in medication warnings;
  • Changes in diagnostic standards;
  • Changes in professional recommendations;
  • Changes in federal or state law; or
  • Changes in Practice services or policies.

Publication and update dates may indicate when content was prepared or revised, but they do not guarantee that every statement remains current.

The Practice does not warrant that Website information is complete, error-free, or appropriate for every person.

13. Third-Party Information and External Links

The Websites may contain links to third-party websites, scheduling platforms, payment services, patient portals, telemedicine services, maps, social-media platforms, public-health resources, or educational materials.

External links are provided for convenience and general information.

The Practice does not control and is not responsible for the:

  • Content;
  • Availability;
  • Accuracy;
  • Privacy practices;
  • Security;
  • Accessibility;
  • Products;
  • Services; or
  • Opinions of an external website.

A link does not necessarily constitute medical endorsement of every statement, product, service, or practice offered by the third party.

14. Testimonials and Reviews

Patient testimonials and online reviews describe individual experiences.

They do not represent a guarantee, warranty, or prediction concerning another person’s treatment, experience, outcome, appointment availability, diagnosis, or relationship with the Practice.

Individual experiences vary based on symptoms, diagnosis, medical history, treatment adherence, medication response, personal circumstances, and other factors.

The Practice’s display of a review does not waive patient confidentiality or authorize the Practice to discuss the reviewer’s care publicly.

15. Communications Are Not Confidential Medical Consultations

Messages submitted through public Website forms, ordinary email, social media, or general voicemail are not a substitute for a confidential clinical consultation.

Do not send unnecessary sensitive information through these channels.

The Practice cannot guarantee that:

  • A message will be received;
  • A message will be reviewed immediately;
  • A transmission will be error-free;
  • A transmission will remain completely confidential; or
  • A response will be provided within a particular time.

Existing patients should use the communication method designated by the Practice for medical questions, medication matters, and confidential records.

16. Geographic and Licensing Limitations

The Websites are operated from the United States.

The availability of clinical care depends on provider licensure, your physical location, the requested service, and applicable law.

Website accessibility from a particular state or country does not mean that the Practice is authorized or available to provide clinical services in that location.

17. No Legal, Employment, Disability, or Aviation Advice

Information concerning independent evaluations, workers’ compensation, disability, employment, fitness for duty, aviation matters, or expert-witness services does not constitute legal advice.

It also does not guarantee:

  • Eligibility for benefits;
  • Approval of a claim;
  • Employment clearance;
  • Return-to-work authorization;
  • Disability status;
  • Fitness-for-duty status;
  • Aviation certification;
  • Licensing approval; or
  • A particular legal or administrative outcome.

Consult an appropriately qualified attorney or professional regarding legal rights, deadlines, claims, or regulatory requirements.

18. Reliance on Website Information

You assume responsibility for how you use general Website information.

To the fullest extent permitted by applicable law, KC Psychiatry & Primary Care is not responsible for loss, injury, or damage arising from:

  • Reliance on general Website information instead of professional care;
  • Delay in obtaining medical or emergency assistance;
  • Self-diagnosis;
  • Self-treatment;
  • Medication changes made without professional guidance;
  • Use of an external website;
  • Technical interruption;
  • A missed or delayed electronic communication; or
  • Unauthorized access outside the Practice’s reasonable control.

Nothing in this Disclaimer excludes or limits a responsibility that cannot lawfully be excluded or limited.

19. Updates to This Disclaimer

The Practice may update this Medical Disclaimer to reflect changes in Website content, Practice services, technology, law, or professional guidance.

The updated version will be posted with a revised effective date.
