Who Qualifies as an Expert Witness?

An expert witness is typically a licensed psychiatrist or psychologist with advanced training and experience in the evaluation of psychiatric conditions. Their qualifications are based on:

  • Formal education, medical degree, and specialty training in psychiatry or psychology.
  • Board certification or equivalent recognition of expertise.
  • Extensive clinical experience with a wide range of psychiatric diagnoses.
  • Prior involvement in forensic evaluations or courtroom testimony.

What Does an Expert Witness Do?

The primary role of an expert witness is to provide independent, objective analysis of an individual’s mental health condition. Their duties often include:

  • Reviewing relevant medical, psychological, and legal records.
  • Conducting interviews or examinations when requested.
  • Explaining psychiatric diagnoses, symptoms, and functional impairments in plain, understandable language for the court.
  • Providing opinions on causation, prognosis, disability, or competency.
  • Delivering expert testimony in depositions, hearings, or trials.

No Doctor–Patient Relationship

It is important to understand that an expert witness does not act as a treating physician. There is no doctor–patient relationship established during the evaluation, and confidentiality is limited to the legal process. The expert’s duty is to the court, not to the individual being evaluated.

When Is Expert Testimony Needed?

Expert psychiatric testimony is often used in cases involving competency to stand trial, criminal responsibility, disability claims, workplace disputes, malpractice cases, and personal injury litigation.
